OF DENISE SMITH
ORDER OF PUBLICATION
The object of this suit is to quiet title and partition real property related to the death of Ms. Denise K. Smith, who died intestate. Ms. Smith had an ownership interest in several pieces of real estate located in Buckingham County. The Petitioner seeks the Court’s determination as to the lawful heirs or beneficiaries of the estate, pursuant to Virginia Code §
64.2-200, determination of the respective ownership interests in the real property, and where necessary, the authority to transfer, sell, or otherwise dispose of such property pursuant to Virginia Code
64.2-106.
The petitioner, Melville D. Jones, is moving the court to enter an Order of Publication pursuant to Virginia Code §
8.01-316, authorizing notice to be served by publication upon unknown heirs or missing parties who may have an interest in this proceeding, and whose names or whereabouts cannot be ascertained with due diligence.
It appears by affidavit filed according to law that the Petitioner has used due diligence to ascertain the identity and location of all heirs and interested parties in the Estate of Denise K. Smith, and that there may be one or more people whose names, whereabouts, or existence are unknown, or who cannot be personally served.
It is hereby Ordered that all other unknown heirs, devisees, successors, or assigns of the said Denise Smith, and any other person who may have an interest in this matter, appear on or before the 25th day of March, 2026, at 4:30 p.m., and take such action as they deem appropriate to protect any interests they may have in the above estate. Appearance may be made in writing or before the date and time indicated.
It is further ORDERED that the Clerk of the Circuit Court forward a copy of this Order of Publication and a copy of the Motion to each defendant at the above address by certified mail, return receipt requested.
It is further ORDERED, pursuant to Virginia Code Annotated §
8.01-317, that this Order of Publication be published once a week for four successive weeks in the Farmville Herald, a newspaper of paid general circulation in the County Of Buckingham, and that a copy be posted on the Court’s Notice Board at the Courthouse in Buckingham, VA.
